Welcome to PrivateHost.AI, a service provided by Uptown4, Inc. (“Uptown4”, “we”, “us”, or “our”). These Terms of Use (“Terms”) govern your access to and use of the PrivateHost.AI service (“Service”). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.
User Content
The Service allows users to upload files and run virtual machines (“VMs”) for their personal, non-commercial use. You are solely responsible for the content you upload and store within your VMs (“User Content”).
Prohibited Uses
You agree not to upload, store, or process any User Content that:
- Violates any applicable law or regulation.
- Infringes the intellectual property rights of any third party.
- Contains viruses, malware, or other harmful code.
- Is obscene, defamatory, or otherwise offensive.
- Contains Protected Health Information (“PHI”) as defined by the Health Insurance Portability and Accountability Act (“HIPAA”).
HIPAA Disclaimer
PrivateHost.AI is not HIPAA compliant and is not intended for the storage or processing of PHI. We strongly advise against uploading any User Content that contains medical records or other sensitive health information.
Data and File Encryption
We employ industry-standard encryption at rest to protect your User Content stored on our servers. However, we cannot guarantee the absolute security of any information transmitted over the internet or stored electronically. You acknowledge and accept the inherent security risks involved in using the internet and online services.
Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranty of any kind, express or implied. Uptown4 disclaims all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. Uptown4 does not warrant that the Service will be uninterrupted, error-free, or virus-free.
Limitation of Liability
Uptown4 shall not be liable for any damages arising out of or related to your use of the Service, including, but not limited to, direct, indirect, incidental, consequential, or punitive damages.
Termination
Uptown4 may terminate your access to the Service at any time, with or without cause, upon written notice. You may also terminate your account at any time.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.
Entire Agreement
These Terms constitute the entire agreement between you and Uptown4 with respect to the use of the Service and supersede all prior or contemporaneous communications and proposals, whether oral or written.
